  • Distribution of marketing without consent based on previous purchases with us, in cases where we choose to utilize this option under the Marketing Act.

Bühlmann processes your personal data on the following grounds:

  • Legitimate interests: We process your personal data based on our legitimate interest in marketing to you in cases where consent is not required, as well as our legitimate interest in conducting statistics and analyses to develop and improve our services (General Data Protection Regulation, Article 6(1)(f)).
  • Contractual obligations: We process your personal data in order to fulfill the purchase agreement entered into with you, including in order to be able to deliver the ordered goods, handle complaints, returns, etc. ((Article 6, paragraph 1, litra b, of the General Data Protection Regulation).

Legal basis for processing
Bühlmann processes your personal data on one or more of the following grounds:

  • Consent: The Bühlmann family will only use your personal data for direct marketing, including sending newsletters, if you have given your prior and express consent to this (Article 6, paragraph 1, litra a, of the General Data Protection Regulation).
  • Legitimate interests: We base the processing of your personal data in connection with analysis and statistics on our legitimate interests in being able to improve and develop our services (Article 6, paragraph 1, litra f, of the General Data Protection Regulation).

When you apply for a job at the Bühlmann family, we process your personal data in connection with the recruitment process. We recommend that your application does not contain civil registration numbers or sensitive personal data, such as personal data revealing racial or ethnic background, religion, trade union membership, sexuality or health information.

Bühlmann may collect, process, and store the following types of personal data about you:

  • Contact information such as name, email address and phone number
  • Information provided in the application, CV and any appendices
  • Relevant information publicly avaliable on the internet and social media, in particular information about previous employment, activites, competencies, performance and general appearance

  • References from previous and/or current employers that you have provided in your application, or whom you have consented us to contact

  • Other information you provide to us in connection with the recruitment process

Legal basis for processing
Bühlmann processes your personal data on one or more of the following grounds

  • Legitimate interests: We may process your personal data based on our legitimate interest in assessing whether we wish to offer you employment. This includes information you provide in your CV, application, and any attachments, relevant publicly available information on the internet and social media, results from personality tests, references from referees you listed in your application, and any other information you provide us during the recruitment process. The processing may also be necessary for our legitimate interest in defend or assert legal claims (Article 6, paragraph 1, litra f, Of the general Data Protection Regulation).
  • Consent: If we wish to obtain references from previous and/or current employers, that you have not specified as references in your application, we will only do this if we have obtained your consent to this (data protection regulation article 6, paragraph 1, letter a). If the position you have applied for exceptionally make special demands on health conditions, we will – after concrete assessment – ask for your express consent prior to the processing of such personal data (Article 9, paragraph 2, litra a and Article 6, paragraph 1, litra a of the General Data Protection Regulation).

This section contains the policy for Familien Bühlmann’s processing of personal data about owners of sole proprietorships or contact persons at suppliers and other business partners who cooperate with Familien Bühlmann.

  • When you have shown an interest in Familien Bühlmann’s products and services, for example by giving Familien Bühlmann your business card

  • Name, e-mail address, telephone number and corresponding contact information
  • Organizational information such as company name and address, job title, area of employment, primary place of work and country
  • Contractual information such as orders, invoices, contracts and other agreements between your company (or your employer) and Familien Bühlmann, which may contain e.g. your contact information
  • Financial information, such as payment terms, bank details and credit ratings (if it is a sole proprietorship)

We can receive such information directly from you (primarily through e-mails and other correspondence with you) or from a third party such as your employer.

  • Administration such as processing of payments, evaluation of credit ratings, accounting, auditing, as well as to provide support

  • Legitimate interests: We may process your personal data on the basis of our legitimate interests in, for example, managing day-to-day operations in accordance with legal and fair business practices, including planning, execution and administration of the collaboration or our legitimate interest in e.g to improve and develop our products and services. Processing may also be necessary for our legitimate interest in preventing fraud or in establishing, defending, or exercising legal claims (General Data Protection Regulation, Article 6(1)(f)).
  • Legal obligation: The processing of your personal data will in some cases be necessary for compliance with legal obligations, such as our obligation to prevent illegal activities (Article 6, paragraph 1, litra c, of the General Data Protections Regulation).

6.1 WHEN YOU VISIT OUR HOTELS AND RESTAURANTS

This section contains the policy for Familien Bühlmann’s processing of personal data about guests and other visitors to Familien Bühlmann’s hotels and restaurants.

When you visit one of Bühlmann’s hotels or restaurants, Bühlmann may collect, process, and store the following types of personal data about you:

  • Name, e-mail address, telephone number and corresponding contact information
  • Passport and other identity information where required by applicable legislation
  • Your purchases
  • Payment details
  • Food preferences (e.g. when visiting our restaurants)
  • Photo and video material in connection with monitoring our locations

  • Completion of your reservations, including administration of your stay with us
  • Sending messages to visitors (e.g. link to guest book)
  • Compliance with applicable legislation

  • Contractual obligations: In certain cases, the processing of your personal data is necessary for to be able to fulfill a contract (Article 6, paragraph 1, litra b, of the General Data Protection Regulation).
  • Legitimate interests: In most cases, we base the processing of your personal data on ours legitimate interests in being able to establish, defend or enforce legal claims and in protecting our physical locations. In addition, we base the processing of your personal data on ours legitimate interest in planning and evaluating a visit (Article 6, Paragraph 1, litra f, of the General Data Protections Regulation).
  • Legal obligation: The processing of information about your payment details and your purchases is necessary for the compliance with applicable accounting legislation, VAT legislation and marketing legislation (Article 6, paragraph 1, litra c) of the General Data Protection Regulation) Certain identification information is necessary for compliance with the passport order and the order on foreigners’ access in this country (Article 6, paragraph 1, litra c of the General Data Protection Regulation).


Special notice regarding video surveillance

We have installed video surveillance for crime prevention and safety purposes, in accordance with Article 6(1)(f) of the General Data Protection Regulation and Section 8(3) of the Data Protection Act. Signage is posted in the monitored areas.

The recordings may be reviewed in case of concrete suspicion of criminal acts by visitors or other persons, violation of Familien Bühlmann’s policies and guidelines, internal/external audits or with a view to clarifying disputes

We can pass on the recordings to the police for crime-solving purposes, including if the presentation is subject to legal requirements, cf. the Data Protection Act § 8, subsection 4. If it is necessary to present the recordings for purposes other than those mentioned above, we will request your consent to such disclosure if you are part of it the recordings.

Familien Bühlmann and the providers of the social media are joint data controllers for the processing of personal data collected in connection with your visit to Familien Bühlmann’s profile or page on the individual social media. The Bühlmann family complies with the Danish Data Protection Authority’s guidelines on joint data responsibility and tries to using available tools and means, as best as possible to ensure that you receive information about the processing of your personal data when you visit Familien Bühlmann’s profiles or pages on social media..

  • To provide Familien Bühlmann with statistics that the providers of the social media, among other things, compile on the basis of your visit to our profiles and pages

BehandlingeThe processing of your personal data is based on the following grounds

  • Legitimate interests: The Bühlmann family bases the processing of your personal data on ours legitimate interests in being able to communicate with and market ourselves to you on our profiles at social media, as well as our legitimate interest in improving our products and services (Article 6, paragraph 1, litra f, of the General Data Protections Regulation).
  • The providers of the social media base the processing of your personal data on their legitimate interests, including their interest in improving their advertising system and providing statistics to The Bühlmann family, which the provider of the social media, for example, compiles on the basis of your visit on Familien Bühlmann’s profile or page on social media. In addition, the providers of the social media have a legitimate interest in providing an innovative, individually adapted, secure and profitable service (Article 6, paragraph 1, litra f, of the General Data Protections Regulation).
  • Consent: The social media providers process certain of your personal data in accordance with your consent, which you can withdraw at any time through your privacy settings on the social media (Article 6, paragraph 1, litra a, of the General Data Protections Regulation).

Social media providers may share your personal data with the following categories of recipients

  • Other individuals who visit our social media profile or page (to the extent your information is publicly available)

The providers of the social media may transfer your personal data to recipients outside the EU/EEA in accordance with applicable data protection legislation. You can read more about in the privacy policies of the individual providers.

Your personal data will be deleted when we no longer need to process it for the fulfillment of a or more of the above purposes. However, the information can be processed and stored longer in anonymized form, or if we are obliged to do so according to the law. Accounting material, including personal data that we are obliged to store in accordance with the Accounting Act, is deleted no earlier than 5 years after the end of the financial year to which the information relates.

Special notice regarding newsletters
Your personal data will be stored as long as your consent to receive newsletters is active. We retain documentation of your marketing consent for two years after you have withdrawn your consent to receive direct marketing materials. The retention period is set on the basis of Familien Bühlmann’s legitimate interest in being able to document that direct marketing has taken place in accordance with applicable legislation (Article 6, paragraph 1, litra f of the General Data Protection Regulation).

Special notice regarding job applications
If you are offered a position at Bühlmann, your application and additional relevant personal data collected during the hiring process will be stored in your personnel file with us.

f you are not offered a position, we will retain your application and any additional personal data collected during the hiring process for a period of 6 months following our rejection, unless you have consented to a longer retention period for such personal data.

You can revoke any consents you may have given as part of our employment procedure at any time. Revocation of your consent will have an effect on the future processing of your personal data, but does not affect the lawfulness of the processing based on the consent prior to the revocation. If you wish to withdraw your consent, you can contact us as indicated below.

Video surveilliance
Recordings from video surveillance conducted for crime prevention purposes are deleted or anonymized no later than 30 days after recording, unless it is necessary for Bühlmann to retain the recordings to handle a specific dispute, for example, in connection with investigating a legal violation

In order to fulfill the above purposes, we may give access to your personal data to third parties who, on the basis of a contractual relationship with Familien Bühlmann, provide relevant services. These can be, for example, IT suppliers, mail providers and suppliers of IT solutions. Such service providers will only process personal data in accordance with our instructions according to concluded data processing agreements.

In connection with Familien Bühlmann’s development, the company structure may change, for example in whole or in part sale of the company. In the event of a partial transfer of assets that contain personal data, the processing basis for the associated transfer of personal data is basically the data protection regulation’s article 6, subsection 1, litra f, as the Bühlmann family has a legitimate interest in transfer parts of its assets and make commercial changes.

Apart from what is described above, your personal data will not be passed on to a third party without your permission. However, under certain circumstances and according to the law, it can be necessary to pass on your personal data to:

  • The police
  • Lawyers
  • Auditors
  • Courts
  • Public authorities
  • Potential buyers
  • Group-affiliated companies

If your personal data is transferred to data processors or data controllers established in countries outside the EU/EEA that do not have an adequate level of protection, such transfer will be based on the EU Commission’s standard contractual clauses

  • You have the right to object to our collection and further processing of your personal data
  • You have the right to rectification and deletion of your personal data, however with certain statutory exceptions, including the Accounting Act
  • You have the right to request us to restrict the processing of your personal data
  • In certain circumstances, you can also request to receive a copy of your personal data as well as the transmission of the personal data you have provided to us to another data controller (data portability)
  • You can revoke any consents you may have given at any time. We will hereafter delete your personal data, unless we can continue the processing on another basis. Our newsletter can be unsubscribed by clicking on the link at the bottom of the newsletter
